Dairy farm manure: Liquid gold or pollutant?

Just before the New Year, the Supreme Court of Wisconsin issued a decision in a lawsuit, and it was a blockbuster.

Justice Michael J. Gableman wrote a decision claiming two farm owner insurance policies provided no insurance coverage to the dairy farm owners, because the policies did not cover manure leaching from field application into neighbors’ drinking water wells due to a “pollution exclusion” in the policies.

The Wisconsin Supreme Court held that the farmers’ insurance policies “…unambiguously excludes coverage for well contamination caused by the seepage of cow manure…” because manure is pollution and pollution is not covered by insurance.
